Groups argue EPA defied the court’s dicamba order

Groups attempting to stop the spraying of dicamba herbicides this growing season have submitted their response to EPA’s brief filed earlier this week.

In their response, the Center for Biological Diversity and Center for Food Safety questioned the legality of EPA’s June 8th cancellation order that allowed the continued use of three dicamba herbicides through July 31st.  They say it “flies in the face” of the Ninth Circuit Court’s original mandate that dicamba use be halted.

After it reviews the latest briefs, the court is expected to announce a decision on the plaintiff’s emergency motion to stop the use of dicamba. The timing of that announcement is unclear.
