EPA says agency wants to review 31 refinery exemptions from 2018

EPA says it wants another look at its decision to grant 31 small refinery exemptions under the 2018 Renewable Fuel Standard.

The agency says it would have been “premature” to review its decision prior to the June U.S. Supreme Court hearing where the high court said oil refiners can receive exemptions even after they’ve lapsed.

A federal court in Denver ruled in favor of the ethanol industry in January in the same case.

The EPA is now asking the U.S. Court of Appeals for the District of Columbia to send the Trump decision back to the agency for review and plans to consider any impact of petitions that had been submitted and adjudicated.

Agriculture and biofuels groups have asked the court to vacate the decision, but EPA said in its motion it opposes the move because it “would be disruptive without any immediate benefit” for the parties.
