Supreme Court grants EPA extension to respond to SRE case

The U.S. Supreme Court has granted EPA an extension to respond to a challenge by an oil refiner to the 10th circuit court EPA’s handing of small refinery wavers in January. The EPA reportedly cited the pandemic when asking for more time. The Supreme Court has given the agency until mid-December to respond. HollyFrontier and Wynnewood Refining challenged the ruling in September, seeking a review of the court ruling.

The Renewable Fuels Association and other biofuels groups say EPA’s request for a delay creates uncertainty for biofuels producers and could put off EPA’s renewable fuels volume rules for 2021.
