Silence golden on gap year RFS waiver requests?
Governors’ Biofuels Coalition co-chair Tim Walz of Minnesota is hopeful the silence at EPA over oil refinery “gap year” waivers indicates the 52 petitions will be denied.
He says Administrator Wheeler has yet to respond to a Coalition letter urging EPA to toss out the requests.
“I actually think maybe that’s a good thing, maybe it’s just the eternal optimist in me. But I do think we make the case (because) the waivers were never correct. They were never with the law.”
Walz tells Brownfield the 10th Circuit Court confirmed that earlier this year.
“And now the whole gap year thing is just another attempt to circumvent the courts, is the way we view it. So I think the administrator will get this right.”
A bipartisan group of U.S. Senators has also written EPA encouraging Administrator Wheeler to deny the gap year petitions.
