Court rejects refiners’ request for rehearing on SRE ruling

The 10th Circuit Court of Appeals has rejected a request by refiners for a rehearing of the court’s January ruling on small refinery exemptions (SREs).

The court’s decision could put more pressure on the EPA to apply the ruling nationwide. The American Coalition for Ethanol says the EPA should act immediately to deny most of the 25 RFS waiver requests that are pending for 2019 and “continue to follow this more legally-sensible approach to SREs moving forward”.
